Businesses Sponsoring Overseas Employees - Temporary

Businesses that are finding it difficult to employ qualified and experienced employees from within the Australian labour market can sponsor employees from overseas on a temporary basis to work in Australia for periods of up to 4 years.

The bonus is that secondary applicants such as spouses and dependants of 457 visa holders are able to work and study during their stay in Australia.

There are three stages to the 457 process

  1. Sponsorship - an application must be made to the Department of Immigration and Citizenship (DIAC) to approve the sponsoring business as a business sponsor.
  2. Nomination - The business will need to nominate an employee. The nomination will need to meet occupation, minimum skills, and minimum salary levels.
  3. Visa Application - the nominee identified to fill the position must then make an application to the (DIAC) to apply for a visa to enter or remain in Australia.

Regional Sponsored Migration Scheme (RSMS) - Permanent

This scheme was introduced to allow employers in regional or low population growth areas of Australia to fill skilled positions that they were unable to fill from the local labour market. All areas of Australia are covered except Brisbane, the Gold Coast, Newcastle, Sydney, Wollongong, Melbourne and Perth.

This visa category is available to Australian employers who:

  • Would like to recruit highly skilled workers either from overseas or people temporarily in Australia, and
  • Have been unable to fill their recruitment needs from the Australian labour market or through their own training efforts, and
  • Are in a regional area
  • This visa provides permanent residency for migrants who are approved
Features of this visa include:
  • Two-year employer/employee contract
  • Exemption from work experience requirement
  • Exemptions on age, qualifications and English language, and
  • Priority visa processing.

Where the visa applicant is already in Australia, they must hold a substantive visa with the appropriate working provisions in order to be considered for this scheme.

RSMS process consists of 3 separate stages:

  1. Certification of the nomination made to the Regional Certifying Body (RCB)
  2. Nomination of the applicant for the position by the Business
  3. Nominee's application for the visa to DIAC
